Exhibition Limited is a licensed second-hand dealer under the Secondhand Dealers and Pawnbrokers Act 2004. Our registration number is 16-032550.
We sell a range of second-hand (unless otherwise specified) items on our website and from our showroom at 35 Dedwood Terrace, St Mary’s Bay. We also provide an on-line platform called Re-Exhibit for third parties to sell or hire their own items.
If you are selling, buying or hiring from Re-Exhibit you should refer to the Re-Exhibit section below. You agree to these terms and conditions by submitting an item to list on Re-Exhibit and by entering into an agreement as a buyer on Re-Exhibit.
BUYING FROM EXHIBITION
What we sell
We sell a range of second-hand items but we do offer new items from time to time. Because of most of our items are second-hand, the same standard of warranties do not apply as to goods sold as new.
Our products aren’t perfect and are in used condition. That is Exhibition’s business and we will not accept returns simply on this basis.
We photograph all our items and we suggest that you look carefully at the photographs before you make a decision to buy. If you want to ask us questions or view items then please contact us. We suggest you view higher value items at our showroom before you buy.
The colour of items may differ depending on the resolution of the device on which you use our website. From time to time, mistakes may occur in the description of items listed. We reserve the right to correct any errors on our website.
Copyright is retained in all Mr Rogers’ artworks and does not transfer on purchase of an artwork..
Refunds and returns policy
We understand our obligations to consumers under the Fair Trading Act 1986 and Consumer Guarantees Act 1993 and nothing in these terms and conditions limits your rights under this law.
If you are not satisfied with your purchase for any reason, please contact us outlining your concerns (with photos if possible). We will then contact you to try to find a solution, which may include arranging for the exchange or replacement of the item you have purchased or providing a credit at our discretion.
We will refund the purchase price if the fault with the item is substantial in accordance with the Consumer Guarantees Act 1993, or otherwise at our sole discretion. Please choose carefully, however, as we do not offer refunds if you have simply changed your mind.
If undamaged items are returned to us for exchange, we do not refund any packing and postage charges. Return of undamaged goods for exchange is entirely at your own cost and risk.
Payment Exhibition uses Braintree Payments, a PayPal company, to facilitate all transactions. Braintree is a trusted payments platform and includes sophisticated fraud protection. For more information, visit www.braintreepayments.com
The prices for items purchased on Exhibition’s website do not include delivery costs. The purchase price is for a ‘click and collect’ service where you, the buyer collects your item from our Central Auckland showroom at 35 Dedwood Tce. We will hold items for a reasonable length of time at your convenience. We will ship items to you using third party couriers or postal services. Items are at your risk once they are collected by the courier or delivered to the post office.. We suggest you get a shipping and insurance quote from us before you purchase to avoid surprises. Many items are fragile or large and may be more expensive to send than you anticipate.
BUYING, HIRING AND SELLING ON RE-EXHIBIT
The Re-Exhibit part of our website is a platform for third parties (‘sellers’) to sell or hire their own items to potential buyers/hirers (‘buyers’). We carefully curate all items listed on Re-Exhibition to ensure that our brand of ‘re-invented style’ is protected.
Buying and selling on Re-Exhibit
The items listed on Re-Exhibit are the property of the individual seller. We put interested buyers in touch with sellers by providing contact details. If, after making contact, you buy or sell or hire one of these items, it is a private sale or rental agreement between the buyer and the seller. This means that you enter into a contract directly with the other party.
We do not take any part in the sale of the items (apart from providing contact details and taking a commission from the purchase/hire price) and are not the seller’s agent.
Unless the seller is “in trade”, the protections under the Fair Trading Act 1986 and Consumer Guarantees Act 1993 will not apply to the sale or purchase or hire of the items listed on Re-Exhibit.
The seller must be legally able to sell the items they offer for listing.
The seller is responsible for the accuracy of the item description and its photography, pricing the item, ensuring the item is in the condition represented on Re-Exhibit and delivery of the item to the buyer.
We list items on Re-Exhibit on behalf of sellers at our sole discretion. We may take any listed items down from our website at our sole discretion on notification to you.
It is free for a seller to list on Re-Exhibit. When a seller’s product is sold, you, the seller, let Exhibition know by phone or email, we remove the listing and you pay a fee, which is 15% of the total amount paid by the buyer (excluding delivery costs).
The fee is for using the Re-Exhibit platform. You should consider this fee when pricing your item.
As the items listed on Re-Exhibit are the property of the individual seller, we do not make any guarantees or representations about these items. If you have any questions about a particular item, please contact the seller directly.
Means of payment for items is as agreed between the buyer and the seller.
Hiring periods and prices are indicated on the website and generally start from a 48 hour minimum hire. However, these periods and prices may be negotiated between the buyer and the hirer (seller). The seller is responsible for payment of the 15% fee of the total hiring cost to Exhibition.
The seller is responsible for their own terms of hire, which may include taking a deposit, requiring evidence of insurance in the event of loss or damage and stipulating additional terms of hire, if any.
This policy governs the use of your personal information by Exhibition Limited (“we” or “us”).
Security of information
We do not make any warranties in relation to the security of any information you disclose or transmit to us and we are not responsible for the theft, destruction, or inadvertent disclosure of your personal information where our security measures have been breached.
A cookie is a data file that is sent to your browser from a web server and stored on your computer (or other device), then sent back to the server by your browser each time you access certain sections of our Site.
